OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lifting parts: (a) On or about July 19, 2012, and times prior to that date, employees were exposed to crushing hazards while working around and under the Challenger and Bend Pak 2-post lifts in that the lifts were not being lowered onto the safety locks when elevated. (b) On or about July 19, 2012, and times prior to that date, employees were exposed to struck by hazards while working around the Challenger 2-post lift with the lateral restraint lock inoperable. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and/or ANSI B153.1 which includes, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturers' specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Ensure all lifts are rated and marked with their load capacity. 4. Schedule and complete all periodic and annual inspections.
