OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to fall hazards when working with, on or around suspended window cleaning equipment in the following instances: (e) On May 14, 2012, at the USDA Building located at 6501 Beacon Dr., Kansas City, MO., the employer did not have available at the jobsite at least one other co-worker equally proficient in the use of the rope decent system and rescue procedures, in that a worker was left to work alone to engage in High Rise Window Cleaning work with no provisions for an emergency event. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.28(j)(4): The lifelines were not securely attached to substantial members of the structure (not scaffold), or to securely rigged lines, which would safely suspend the workers in case of a fall: (a) On May 14, 2012, at the USDA Building located at 6501 Beacon Dr., Kansas City, MO., an employee preparing to engage in window cleaning activities had not secured his lifeline to a substantial independent structural anchor point, subsequently falling over 71 feet to the ground. As a result, the employee received life threatening injuries and was transported to a local hospital for an extended period of treatment. Abatement certification for this violation is not required.
