29 CFR 1910.95(c)(1):  The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent:    a)  On or about June 14, 2011 and at times prior, the employer did not protect the hearing of employees by developing and implementing a hearing conservation program which included initial noise monitoring, baseline and annual audiograms, and employee training for employees that worked in the sawmill and planer areas.  Employees working in these areas were exposed to an 8-hour time-weighted average (TWA) sound level of greater than 85dBA (50% dose).      On July 20, 2012, the following employees were exposed to the following:           1.  An employee working in the sawmill area was exposed to noise at a level of 95.4 dBA (98.5% dose) for a 3 hour and 43 miinute monitoring period.             2.  An employee working in the planer area was exposed to noise at a level of 99.5 dBA (181.5% dose) for a 3 hour and 54 minute monitoring period.           3.  An employee working in the sawmill area was exposed to noise at a level of 94.2 dbA (92.5% dose) for a 4 hour and 7 minute period.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a)  On or about July 20, 2012, and at times prior, employees performing maintenance work were exposed to amputation, struck by, and caught between injures from the following equipment:        1.  Resaw      2.  Hog      3.  Edger      4.  Sawdust Chain      5.  Head Rig    Abatement Note:  Abatement certification is required for this item (see enclosed Sample Abatement-Certification Letter).

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) On or about July 20, 2012, and at times prior, employees were exposed to amputation hazards from working with/around the following equipment:       1.  Un-guarded rotating shaft on the planer feeder bin.       2.  Un-guarded rotating roller on the planer feeder area.       3.  Un-guarded rotating shaft on the electrical motor powering the dust extractor.       4.  Un-guarded saw in the saw mill.
