OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard.    (a)   Feed Mill, on July 17, 2012, and at times prior thereto,  employees were working in feed mixing area where employees routinely climbed a fixed ladder to an unguarded observation platform approximately 14 feet above the concrete floor to view the in-feed to the big mixer.

OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near dust accumulations in Class II areas.                        (a)   Feed Mill, on July 17, 2012, and at times prior thereto,  employees were exposed to combustible dust hazards in a feed mixing area where there were 1/2 inch to over 3 inch accumulations of Class II combustible dusts.  No documented housekeeping plan or program was in place to minimize dust accumulations.      (b)   Feed Mill, on July 17, 2012, and at times prior thereto,  employees were exposed to combustible dust hazards in a feed mixing area where 1/2 inch to over 3 inch accumulations of Class II combustible dusts were routinely cleaned with compressed air.  No safety procedures were in place to eliminate sources of ignition before using the compressed air for blowing down the dust accumulations.     (c)   Feed Mill, on July 17, 2012, and at times prior thereto,  employees exposed to combustible dust hazards in a feed mixing area where there were 1/2 inch to over 3 inch accumulations of Class II combustible dusts.  No warning signs of potential dangers were posted at the entrances to the building .     (d)  Feed Mill, on July 17, 2012, and at times prior thereto, employees were exposed to a feed mixing area where there were 1/2 inch to over 3 inch accumulations of Class II combustible dusts.  The pendant light and the trouble light near the Big Mixer were not approved for a hazardous location.

(a)   Maintenance/welding shop, on July 17, 2012, and at times prior thereto, employees were exposed to over 90 p.s.i. while cleaning parts and employees with compressed air.       (b)   Feed Mill, on July 17, 2012, and at times prior thereto, employees were exposed to over 100 p.s.i. while cleaning parts, equipment, and employees with compressed air.    (c)  Auto shop, on July 17, 2012, and at times prior thereto, employees were exposed to over 30 p.s.i. while cleaning parts with compressed air.
