29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) On or about July 17, 2012, and at times prior, the employer did not have a Hazard Communication Program for employees who handle hazardous workplace chemicals such as, but not limited to, synthetic stucco and stucco color tint, at Agan Drywall Supply, Inc. located at 2609 Carolyn Avenue in Sioux Falls, South Dakota.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate:    (a) For the storage areas located above work and storage areas at Agan Drywall Supply, Inc. at 2609 Carolyn Avenue, Sioux Falls, South Dakota, on or about July 17, 2012, and at times prior, without load ratings posted for the acceptable capacity of the mezzanine.
