29 CFR 1926.451(a)(1):     Scaffold(s) and scaffold(s) component(s) were not capable of supporting, without failure, its own weight and at least four times the maximum intended load applied or transmitted to it:    On or about July, 24, 2012, the employer exceeded the load imposed on a mobile scaffold (scissors lift) guardrail by an employee sitting on guardrail to perform work activities.    STRUCTURAL ERECTING AND ASSEMBLY, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.453(b)(2)(iv), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313894180, CITATION NUMBER 01, ITEM NUMBER 001, AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 13, 2010 WITH RESPECT TO A WORK PLACE LOCATED AT 1500 BROOKPARK ROAD, CLEVELAND, OHIO 4109.

29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    On or about 7/24/12 during construction activities including but not limited to work from an elevated platform, the employer did not ensure employees performing work on a scaffold were properly trained.
