29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Greenbuilt, LLC @ 801 Walnut St., Louisville, CO 80027: On 7/24/12, the employer did not ensure that a safety inspection was conducted by a competent person. Employees were exposed to fall hazards while working on the deck of the second floor on a new residential home. This condition exposed employees to fall hazards of approximately 11 feet 1 inches and 19 feet 8 inches.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: (a) Greenbuilt, LLC @ 801 Walnut St., Louisville, CO 80027: On 7/24/12, the employer did not ensure that employees were protected from a fall hazard. Three employees were exposed to a fall hazard while stacking building materials the second floor of a new, residential home. This condition exposed employees to a fall hazard of approximately 11 feet 1 inches as measured from the ground to the deck of the second floor. (b) Greenbuilt, LLC @ 801 Walnut St., Louisville, CO 80027: On 7/24/12, the employer did not ensure that employees were protected from a fall hazard. Employees were exposed to an unguarded stairway opening which measured approximately 7 feet 4 inches by 9 feet 4 inches while stacking building materials on the second floor of a new, residential home. This condition exposed employees to a fall hazard of approximately 19 feet 8 inches as measured from the basement to the deck of the second floor.
