On or about 4/3/2012 a) Jobsite safety inspection was not provided by the employer; employees were exposed to safety hazards at the construction site; 30 ft fall hazards, rebar impalement hazard, 700 lb load of decking slipped of the crane sling due to improper sling attachment; load fell and partially collapsed the scaffold employees were standing on. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) though (vii) establish the types of fall protection to be provided to employees on each type of scaffold. Paragraph (g)(2) addresses fall protection for scaffold erectors and dismantlers: Location: 331 E 6th street, New York, N.Y; construction jobsite. On or about 4/3/2012 a) Two employees were exposed to falling 30 ft when standing on the pipe scaffold at the front of the building while guiding a load of decking being lifted by a crane (boom truck crane). The load of decking slipped out of the crane sling and fell, causing partial collapse of the scaffold and causing additional fall hazard to the two employees. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.701(b): All protruding reinforcement steel, onto and into which employees can fall, was not guarded to eliminate the hazard of impalement: Location: 331 E 6th street, New York, N.Y; construction jobsite. On or about 4/3/2012 a) Numerous rebar pins were sticking up 18 inches from the top deck (4th floor) at the construction site. Rebar tips were not protected with caps, wood, or otherwise protected. Employees can trip and fall onto the rebar, exposing them to impalement hazard. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.753(d)(2)(i): Materials being hoisted shall be rigged to prevent unintentional displacement: Location: 331 E 6th street, New York, N.Y; construction jobsite. On or about 4/3/2012 a) Due to unsafe rigging of a crane load, employees were exposed to several hazards; crane load falling/ scaffold collapse/ fall hazards: A load of 7 pieces of corrugated metal decking weighing up to 600 lbs fell 30 feet when it slipped from the nylon sling being lifted by a boom truck crane. The load tipped one end up and slid out of the sling. The sling was a single leg center rigged instead of the more stable double leg (upside down Y) rig. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.753(d)(2)(iii): All loads shall be rigged by a qualified rigger: Location: 331 E 6th street, New York, N.Y; construction jobsite. On or about 4/3/2012 a) The employer did not have a rigger who was qualified by OSHA definition. The OSHA definition of qualified means the rigger will have sufficient training or experience to know what rigging methods are needed for a safe crane lift; in this case to use a sling attachment that will keep the load stable. Due to unsafe rigging of a crane load, employees were exposed to several hazards; crane load falling/ scaffold collapse/ fall hazards: A load of 7 pieces of corrugated metal decking weighing up to 600 lbs fell 30 feet when it slipped from the nylon sling being lifted by a boom truck crane. The load tipped one end up and slid out of the sling. The sling was a single leg center rigged instead of the more stable double leg (upside down Y) rig.
