29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: a) On or about July 24, 2012 and at times prior, Tripp Construction, Inc. as a controlling/correcting employer, did not ensure that subcontractor employees were protected from falls from window and door openings greater than 6 feet from a lower level in that several wall openings on the north side of the building were missing complete guardrail systems. At least one opening had no guardrail system at all, at least one was missing a top rail and several were missing midrails.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail: a) On or about July 24, 2012 and at times prior, Tripp Construction, Inc. as a controlling/correcting/exposing contractor, did not ensure that at least one handrail was provided in the east and west stairwells in the building under construction. Tripp Construction, Inc. was previously cited for a violation of the Occupational Safety and Health Standard, or its equivalent 29 CFR 1926.1052(c)(1) which was contained in OSHA inspection 312141344 Citation 1 Item 5, issued on June 26, 2009 and became a final order on July 9, 2009 with respect to a worksite located at 1302 N. Main, Lamar, CO 81052.
