OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries:    a)  On or about June 11, 2012 and at times prior, employees of RBS Framing, Inc. as well as employees of other contractors were exposed to crushing injuries when a stack of decking (OSB) collapsed through the trusses it was placed on and through several other floors, landing at the basement level.  The stack of material was placed innappropriately in the center of trusses which could not support the load.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:    a)  On or about July 24, 2012 and at times prior, employees were not protected from falls from window and door openings greater than 6 feet from a lower level in that several wall openings on the north side of the building were missing complete guardrail systems.  At least one opening had no guardrail system at all, at least one was missing a top rail and several were missing midrails.  Employees had also removed a top rail from a window opening o nthe third floor and were shoveling trash out the window.
