29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On July 25, 2012, an employee was not protected by a hard hat while working in a trench where overhead hazards existed, exposing him to a struck-by hazard.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    29 CFR 1926.651(j)(2):     On July 25, 2012, an employee was exposed to the hazards associated with a spoil pile that was not placed at least two feet from the trench edge.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.    On July 25, 2012, an employee was not provided any cave-in protection, exposing him to the hazards associated with working in a 6 foot deep unprotected trench.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
