29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. (a) Construction site - On or about July 10, 2012 an employee was observed driving a Pettibone forklift (model no. 6044) without wearing a seat belt. (b) Construction Site - On or about July 10, 2012 an employee was observed operating a John Deere 310G front end loader without wearing a seat belt.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Left Side of Building - On or about July 10, 2012 two employees were exposed to a fall hazard while working from a JLG-450A aerial lift. These employees were elevated 12 feet above the ground without wearing a body belt or body harness.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Northeast side of Roof - On or about July 10, 2012 one employee was exposed to a fall hazard while working on edge of the roof 13.7 feet above the ground with no guardrail system or safety net system or personal fall arrest system.
