29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about 07/25/2012, on the face of the building, the employer did not ensure that employees using two JLG scissor lifts to bolt down light installations over ten (10) feet high were protected from falling. The mid-rail chain on each of the scissor lifts was not closed to complete the guardrail system.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about 07/25/2012, the employer failed to ensure that an employee was protected from falling upon climbing out of the scissor lift and on to a brick wall at an elevation of over ten (10) feet. The employee was sitting on top of the wall bolting down light installations.
