29 CFR 1910.134(c)(2)(i):     An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and    The employer is failing to protect employees from potential respiratory hazards associated with uniformed employees voluntarily using company provided respirators.  This was most recently evident during the inspection of the facility located at 7404 Lake Cunningham Road, Omaha, NE 68122, where the employer has uninformed employees voluntarily wearing company provided respirators, 3M dust masks, in the accomplishment of their duties without having been provided necessary safety information as contained in Appendix d of this subpart.

29 CFR 1910.303(b)(2):     Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.    The employer is failing to protect employees from potential electrical hazards associated with using improper portable power taps as a means of providing power to remote equipment.  This was most recently evident during the inspection of the facility located at 7404 Lake Cunningham Road, Omaha, NE 68122, where the employer has employees operating the VF-4 CNC machine where the employer has hooked up a Wayne manufactured mini-skimmer to a Belkin Surge Protector that was originally designed for use with low wattage computer equipment and peripherals as a means of skimming the residual oil form the coolant reservoir; however the 6 cord was hanging from an outlet mounted on the back of the VF-4 CNC machine 7 above the floor causing the undo strain to pull the plugs from the outlet reducing the amount of contact and increasing the potential for an employee to be injured as a result of contact with the live electrical circuits or the damaged cord as a result of the weight of the portable power tap hanging down and creating a tight bend in the cord near the plug.

29 CFR 1910.305(g)(2)(iii):     Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws.    The employer is failing to protect employees from potential electrical hazards associated with insufficient strain relieve on portable power taps. 29 CFR 1910.147(c)(6)(ii):     The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.    The employer is failing to protect employees from potential electrical and amputation hazards associated with failing to certify that annual periodic reviews.  This was most recently evident during the inspection of the facility located at 7404 Lake Cunningham Road, Omaha, NE 68122, where the employer has employees operating and maintaining the VF-4 CNC machine while using written specific procedures that are not certified as having been reviewed within the past year.

The certification shall contain each employee's name and dates of training.    The employer is failing to protect employees from potential electrical and amputation hazards associated with failing to certify that authorized employees are trained in accordance with this subpart.  This was most recently evident during the inspection of the facility located at 7404 Lake Cunningham Road, Omaha, NE 68122, where the employer has uncertified employees de-energizing the VF-4 CNC machine and others in support of Lockout and Tag out program prior to performing maintenance.
