This violation was observed on or about July 26, 2012 in the warehouse area where each exit was not marked exposing employees to fire hazards.

29 CFR 1910.132(a): Protective equipment was not provided and used when necessary whenever hazards capable of causing injury and impairment were encountered.     The employer does not ensure that seat belts are provided for employees to utilize while operating forklifts.  This condition was observed on or about July 26, 2012, at the facility where an employee was exposed to a struck-by hazard while operating the TCM forklift without a seat belt.

29 CFR 1910.178(p)(1):     Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition    The employer did not ensure that industrial trucks in need of repair, defective, or in any way unsafe are taken out of service until being restored to safe operating condition.  This violation was observed on or about July 26, 2012, in the warehouse area where employees were exposed to a struck-by hazard while operating the TCM forklift that was unsafe in that it did not have a seat belt.

29 CFR 1910.178(l)(2)(ii):  The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    The employer does not ensure that operators are trained in the safe operation of power industrial trucks.  This violation occurred on or about July 26, 2012 in the warehouse area where employees, who had not been trained in the safe operation of powered industrial trucks, were operating the TCM forklift.
