29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a)  Hidalgo Construction at 447 Jackson Street, Lafayette, CO 80026:  On or before July 21, 2012, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns.  Condition exposed employees to the hazard of projectiles to the eyes.

29 CFR 1926.501(b)(13):  Employees engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b).  Note:  If using these systems was infeasible or created a greater hazard, the employer did not develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502:    a)  Hidalgo Construction at 447 Jackson Street, Lafayette, CO 80026:  On or before July 21, 2012, the employer did not ensure that employees were protected from falling in the following instances:    1)  An employee was sheathing the two-story roof with a 6 in 12 pitch without the use of a personal fall arrest system;    2)  The personal fall arrest systems that had been use did not include rope grabs; and    3)  Employees were framing on the second floor, and 5 windows had window ledges that were either 24" or 36" high, and these windows were not guarded in accordance with 29 CFR 1926.502(b).      Conditions exposed employees to fall hazads of up to 20'.    Abatement note:  29 CFR 1926.502(b) requires that the top edge of the top guardrail shall be 42" +/- 3", and that the midrail be placed midway between the top edge of the top guardrail and the walking/working surface.

29 CFR 1926.1052(c)(1):  Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:    a)  Hidalgo Construction at 447 Jackson Street, Lafayette, CO 80026:  On or before July 21, 2012, the stairs did not include a stairrail over each unprotected edge.  The stairs included 13 steps that were 36" wide, with a rise over run of 7 5/8" over 11".  Condition exposed employees to fall hazards of up to 8'.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a)  Hidalgo Construction at 447 Jackson Street, Lafayette, CO 80026:  On or before July 21, 2012, the employer provided a Skilsaw for use while framing, model HD77, serial number HH239038, that was missing its ground plug.  Condition exposed employees to electrical shock hazards.
