OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were subject to being struck by falling loads from scissor-type below-the-hook lifting devices.    a.  2011A Cell Area for Mori Drilling Machine.  Employees used below-the-hook scissor-type lifting devices to pick up flywheel parts weighing approx. 300-350 pounds.  The below-the-hook lifting devices were not rated and labeled for load capacity and did not have frequent and documented periodic inspections by a qualified person to ensure the devices did not have deficiencies such as deformation, cracks or excessive wear.  The employer did not have a method or procedure to ensure that appropriate lifting devices were matched to specific part(s) being lifted prior to a lift.    There is no abatement certification or documentation required for this item.    2.  Ensure that below-the-hook lifting devices are properly load-tested, rated, labeled, maintained and inspected by a competent person(s) with required documentation as appropriate.    3.  Ensure that all operators are instructed in the safe operation of the devices, including application of the lifter to the load and adjustments, if any, that adapt the lifter to various sizes or kinds of loads.    4.  Develop mechanism for operators to report problems to management and/or take defective devices, when identified, out of service.    5.  Train all affected employees on established safety procedures.    6.  Monitor work practices to ensure compliance with safety procedures.  Establish and enforce discipline policy.
