29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):                                                                       a) Frank Bianco Builder Inc. - On or about July 24, 2012, the employer did not conduct frequent and regular inspections of the site and an erected scaffold to protect employees from struck by hazards.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.    a) Frank Bianco Builder Inc. - On or about July 24, 2012, an employee working below a fabricated frame scaffold was not provided with additional protection from falling hand tools, debris, and other small objects and was not wearing a hard hat.
