29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a): On or about July 26, 2012, and times prior thereto, at the worksite located at 11262 Highway 49 in Poplar Grove, Arkansas, the employer had not developed a documented Emergency Action Plan for the benefit of employees exposed to hazardous conditions such as but not limited to falls, engulfment and suffocation that commonly occur with grain handling.

29 CFR 1910.272(e)(1): The employer did not provide training to employees at least annually and when changes in job assignments would expose them to new hazards in the grain handling facilities: On or about July 26, 2012, and times prior thereto, at the worksite located at 11262 Highway 49 in Poplar Grove, Arkansas, the employer did not provide training to include but not be limited to precautions for off-loading grain storage bins, hazards of flowing grain, emergency procedures, and general safety hazard recognition, precautions and preventive measures associated with grain handling.
