29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    On or about July 25, 2012 and at times prior thereto, for personnel required to operate powered industrial trucks (forklift) and had not received appropriate training as stated in paragraph (l) of the standard. This exposed operators to not knowing about the hazards associated with forklift use such as rollover, lift capacity, and lack of forklift inspection procedures which exposed employees and others to crushing and struck-by injuries.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    On or about July 25, 2012 and at times prior thereto, for employees potentially exposed to chemicals such as, but not limited to, metal fumes from welding, lathe and milling operations, propane, and gasoline. This exposed employees to nose and skin irritation, along with upper respiratory hazards.
