29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) East side of the structure at the lower roof section; On or about July 26, 2012 and at times prior thereto, an employee was walking on/working from the roof deck without a means of fall protection while painting the wall. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) East side of the structure adjacent to the lower roof section, south end; On or about July 26, 2012 and at times prior thereto, an employee utilized a ladder not fully extended to 3 feet above the roof deck he accessed to paint the wall. Note: Abatement certification is NOT required for this item.
