29 CFR 1926.501(b)(13):   Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)  Note:  If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.  On or about June 26, 2012:  Employees of Damien Ponce were exposed to fall hazards while performing residentila constrcution as follows:                 a) Employees exposed to fall hazards of approximately 19.4 feet while installing roof sheathing on a 6 in 12                       pitched roof without fall protection measures.                 b) Employee was exposed to a fall hazard of approximately 9.5 feet while installing framing for front porch                      section of home without fall prtotection measures.

29 CFR 1926.503(a)(1):   The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about June 26, 2012:  Employer failed to implement and train employees in fall protection measures, which would have allowed employees to recognize and minimize fall hazards while being exposed to fall hazards of approximately 19.4 and 9.5 feet, while installing roof sheathing and installing framing componets on porch section of home at Lot 43 located in the Fowler's Mill Subdivison in Cumming , GA.
