29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth: At this excavation site, employees were installing a sewer line in an excavation with vertical walls. The excavation was over 7 feet in depth. The employer did not provide a safe means of egress, as the ladder was positioned in an unprotected area of the trench. Employees were exposed to hazards associated with trench cave-in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): At this excavation site, an employee walked and worked inside an unprotected section of an excavation over 7 feet deep. The walls of the trench were near by vertical; the employee was exposed to hazards associated with a cave-in. Jhabores Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard, 1926.652(a)(1), which was contained in OSHA inspection number 315178921, Citation Number 1, Item Number 3 and was affirmed as a final order on March 24, 2011, with respect to a workplace located at Flour Bluff Drive, Corpus Christi, Texas, 78418.
