29 CFR 1926.405(a)(2)(ii)(D): Disconnecting switches or plug connectors were not installed to permit the disconnection of all ungrounded conductors of each temporary circuit: (a) As observed on or about 08/01/2012, the original circuit branch feeding the 277 volt light fixtures used at room 305 at the Progress Village Middle School was modified as part of a remodeling project. Some light fixtures were removed and the two left that were used as temporary lighting were wired directly to breaker #5 of the Square D Panel Board AE located in adjacent building 2. On or about 07/20/12, an electrician that was pulling wires nearby sustained serious electrical shock when he came in contact with the high voltage branch.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into pysical or electrical contact with the electric power circuit. (a) As observed on or about 08/01/2012, the original circuit branch feeding the 277 volt light fixtures used at room 305 at the Progress Village Middle School was modified as part of a remodeling project. Some light fixtures were removed and two were used as temporary lighting. Verification of the installation workmanship was not conducted to ensure the electrical continuity of the metal flexible conduit of one of the light fixtures. An electrician that was pulling wires nearby sustained serious electrical shock when he made contact with the energized branch. The D&S Electrical Technologies was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.416(a)(3), which was contained in OSHA inspection number 314912569, citation number 1, item number 1 and was affirmed as a final order on 10/14/2010, with respect to a workplace located at Seffner, FL. 29 CFR 1926.403(h): Each service, feeder, and branch circuit was not legibly marked at its disconnecting means or overcurrent device to indicate its purpose, nor located and arranged so that the purpose was evident: (a) Panel CLA (120/208 V) located on the mechanical room behind room # 305 of building 6 at Progress Village Middle School was wired and energized on 07/21/2012. On 07/24/2012 and on 08/01/2012 the panel was observed energized and not marked.

Some light fixtures were removed and the two left were used as temporary lighting. A flexible conduit feeding one of the fixtures was not mechanically connected to the junction box creating a break in the path to ground. On or about 07/20/12, an electrician that was pulling wires nearby sustained serious electrical shock when he came in contact with the high voltage branch.
