29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports:      (a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On or about July 30, 2012 the creating/exposing employer did not ensure each working level of the fabricated frame scaffold was fully planked in that 18 inches of the 5 foot working level was planked.  This condition exposed the employees to a fall of approximately 13 feet.

29 CFR 1926.451(e)(1):  Scaffold platforms that were more than two feet (0.6m) above or below a point of access were not provided with a means of access:      (a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On or about July 30, 2012 the creating/exposing employer did not ensure a ladder was provided to allow for safe access and egress to the fabricated frame scaffold.  Without the ladder the employee climbed the bracing.  This condition exposed the employee to a fall hazard of approximately 13 feet.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:      (a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On or about July 30, 2012 the creating/exposing employer did not ensure the fabricated frame scaffold had been inspected for visible defects by a competent person before use.  Without the inspections employees were exposed to scaffold fall hazards of approximately 13 feet.      Abatement Note:  Concerning the requirements and duties of a competent person:      (1)  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.      (2)  The competent person must be able to carry out the tasks specified in the standard. In order to be able to carry out the tasks the competent person needs to have knowledge in the issues relating to the strength and structural integrity of the scaffold. A competent person must be fully knowledgeable about erecting, disassembling, moving, operating,   repairing, maintaining and inspecting the scaffold.      (3)  Section 1926.454 states that a competent person will train employees involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold. To meet this requirement, a competent person must be fully knowledgeable about erecting, disassembling, moving, operating, repairing, maintaining and inspecting    the scaffold.

(a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On or about July 30, 2012 the creating/exposing employer did not ensure the employee working from a fabricated frame scaffold was protected from falling by adequate fall protective measures in that the working level was not provided with a guard rail system and the employee did not use a personal fall arrest system.  This condition exposed the employee to fall hazards of approximately 13 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:    (a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On or about July 30, 2012 the creating/exposing employer did not have each employee who performs work from a fabricated frame scaffold trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold being used and to understand the procedure(s) to control or minimize those hazards.  This condition exposed the employee to a fall hazard of approximately 13 feet.    Abatement Note: The training shall include the following elements at a minimum:    (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;    (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:    (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;    (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and    (5)  Any other pertinent requirements of this subpart.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a)AJT Construction, LLC at 105 Lusher Ct., Frisco, CO 80443:  On July 31, 2012 the creating/exposing employer did not ensure that each employee engaged in residential construction activities had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.  This condition exposed the employees to a fall hazard of approximately 11 to 21 feet.
