29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  Tim Lemmon, Findlay, Ohio:  On or about July 25, 2012, at address 731 Remington St., Findlay, Ohio, the employer failed to ensure that each employee was protected from head injuries while working below employees conducting roofing work.  Employees were exposed to potential impact injuries caused from falling materials and/or equipment while working and moving around below the elevated working level.

29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):    a)  Tim Lemmon, Findlay, Ohio:  On or about July 25, 2012, at address 731 Remington St., Findlay, Ohio, the employer did not ensure that employees were protected from falls while engaged in roofing work on a steep sloped roof on a residential type structure.  Employees were exposed to a potential fall of approximately 10.6 feet to the ground below, which could result in permanent disability for death.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a)  Tim Lemmon, Findlay, Ohio:  On or about July 25, 2012, at address 731 Remington St., Findlay, Ohio, the employer did not ensure that employees had been trained in the appropriate use of fall protection, such as but not limited to the use of personal fall arrest systems.  Employees were exposed to falls of approximately 10.6 feet to the ground below, which could result in permanent disability or death.
