29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Jobsite- Whitestown Road, Harmony, PA: On or about July 31, 2012 an employee was observed welding a pipe in an excavation that measured approximately 5 feet 11 inches where he was located. Tools such as but not limited to a wrench and hammer were located less than 7 inches away from the edge of the excavation where the employee was located.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i). (a) Jobsite- Whitestown Road, Harmony, PA: On or about July 31, 2012 an employee was observed welding a pipe in an excavation with near vertical walls that measured 5 feet 11 inches in depth without cave-in protection.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) Jobsite- Whitestown Road, Harmony, PA: On or about July 31, 2012 an employee was observed welding a pipe in an excavation without adequate protective clothing on. The employees arms where exposed to burns from the sparks while welding.
