Section 5(a)(1) of the Occupational Safety and Health Act of 1970:     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by:    On or about 07/26/12 and at times prior thereto, the employer did not ensure that employees operating powered industrial trucks use seatbelts, exposing employees to the hazard of falling out of and being struck by the powered industrial truck. This violation was found to exist on or about 07/26/12, where the forklift operator did not use a seatbelt while loading trucks at the dock and operating the forklift throughout the warehouse.

29 CFR 1910.22(d)(1):     In every building or other structure, or part thereof, used for mercantile, business, industrial, or storage purposes, the loads approved by the building official were not marked on plates of approved design which shall be supplied and securely affixed by the owner of the building, or his duly authorized agent, in a conspicuous place in each space to which they relate. Such plates shall not be removed or defaced but, if lost, removed, or defaced, shall be replaced by the owner or his agent:    a)  On or about 07/26/12 and at times prior thereto, an employee was exposed to a struck by hazard while working inside a warehouse office, which had pallets and other material stored on the roof of this office space.  The roof storage area was not marked with load limit signage.

29 CFR 1910.23(a)(1):     Every stairway floor opening was not guarded by a standard railing constructed in accordance with paragraph (e) of this section. The railing was not provided on all exposed sides (except at entrance to stairway). For infrequently used stairways where traffic across the opening prevents the use of fixed standard railing (as when located in aisle spaces, etc.), the guard did not consist of a hinged floor opening cover of standard strength and construction and removable standard railings on all exposed sides (except at entrance to stairway):    a)  On or about 07/26/12 and at times prior thereto, an employee was exposed to a fall from height hazard of approximately 10 feet to the concrete ground below, while accessing a second level storage area.  The stair rail system had a removable midrail access chain, however this chain was broken and was not capable of being attached.
