29 CFR 1915.77(c): When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, either scaffolds or a sloping ladder, meeting the requirements of Subpart E- Scaffolds, Ladders, and Other Working Surfaces, were not provided to afford safe footing, or the employee was not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160:    a) Viking Village, 1801 Bayview Avenue, Barnegat Light, New Jersey  An appropriate means of fall protection was not provided for employees who used elevated surfaces such as, but not limited to the roof of the shucking house as work platforms. On 7/31/12, an employee who was removing a lighting fixture was injured when he fell a distance of approximately 6.5 feet from the roof of the shucking house to the deck of the Ms. Manya, a commercial scalloping vessel.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
