29 CFR 1926.404(b)(1)(i):     Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.    a) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY: An employee used a Milwaukee Abrasive Wheel Cutoff Saw (chop saw) to cut PVC pipe. The saw was connected to 120-volt ac power via a series of extension cords, the first of which was plugged into a wall receptacle in the building. No GFCI or assured equipment grounding program was being used.    b) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY: A double work light stand was used to provide lighting in the work area at the west end of the building. The work lights were connected to 120-volt ac power via a series of extension cords, the first of which was plugged into a wall receptacle in the building. No GFCI or assured equipment grounding program was being used.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(4)(ii):     Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:      a) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY:  An employee using a Milwaukee chop saw to cut PVC piping was exposed to the potential of stepping into a nearby shallow, narrow, rectangular floor hole which was left uncovered. This hole was in the west end of the building and the length of the hole ran in the north-south direction. The dimensions of the hole were approx. 15 in. wide x 27 ft. long x 12 in. deep. The purpose of the hole was for the eventual installation of electrical conduit.    b) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY: Employees unloading equipment were exposed to the potential of falling into a rectangular floor hole which was left uncovered. The hole was located just inside the entrance door at the northwest end of the building and was approx. 5 ft. wide x 5 ft. long x 5 1/2 ft. deep.  The hole contained plumbing connections and was left uncovered for the eventual arrival of the city plumbing inspector.      ABATEMENT CERTIFICATION REQUIRED
