OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.     a) Warehouse Areas - Employees were raised on a pallet by a fork lift truck to retrieve items from the top shelf of racking systems.     Among other methods, one feasible and acceptable method to correct this hazard is to include, but not limited to the following:    1) Provide and require the use of a work platform designed to lift personnel in accordance with the American Society of Safety Engineers (ASME), B56.1-2005 Safety Standard for Low and High Lift Trucks, Section 4.17.

29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly:      a) Warehouses - A man lift cage was used to raise employees to retrieve items from the top levels of a racking system.  No manufacturers written approval was completed and the fork lift trucks operation and maintenance instruction plates, tags or decals were not changed accordingly.     In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(m)(10): A load backrest extension was not used whenever necessary to minimize the possibility of the load or part of it from falling rearward:    a) Facility Wide - Three gas powered industrial trucks (Yale Serial # E187V02519T and #E187V02520T, and Komatsu Serial #600387A) did not have a load backrest extension to minimize loads such as ruber hoses from falling rearward.     In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification.
