OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On August 2, 2012 and other times prior thereto, employee(s) engaged in the task of preparing the truck for loading of materials walked on the unguarded, elevated walking/working surface of the truck at heights approximately 12 feet or greater above grade without any means of fall protection.

29 CFR 1904.39(a): An oral report of an employment accident resulting in a fatality or the inpatient hospitatlization of three or more employees was not made within eight (8) hours after the occurrence to the nearest Area Office of the Occupational Safety and Health Administration or to the OHSA toll-free central telephone number (1-800-321-OSHA). Located at 243 North Highway 281A, Three Rivers, TX: On or about August 2, 2012, the employer failed to report to OSHA a work-related death of an employee found lying on the ground next to his truck on July 30, 2012.
