29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:        Location: Jobsite, 14 Councilcrest Road    a) Employee was operating an aerial lift without a body belt, thus exposing the employee to falling out of the aerial lift on or about 08/01/12.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:     Struck by and crushed by hazards as an employee was allowed to operate a JLG Aerial Boom Lift that was not in safe operating condition.    Location: Jobsite, 14 Councilcrest Road    a) Employee(s) operated a JLG Aerial Boom Lift model 150AX with damaged and missing parts which caused the lift to strike a tree, and the operator to be thrown forward into the rails of the lift basket., on or about 08/01/12.    Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to:    1. Follow the JLG Operation and Safety Manual Boom Lift Models 150HAX Instructions, 1.3 Operation "Never operate a machine that is not working properly. If a malfunction occurs, shut down the machine".
