29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer does not ensure that employees on a walking/working surface with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level are protected from falling by a fall protection system. This violation was observed on or about August 1, 2012, at the newly built elementary school where an employee was exposed to a 20 foot fall hazard when sweeping at the edge of the roof without a fall protection system. GAMMA CONSTRUCTION COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312928831 CITATION 1 ITEM 1 AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 16, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 5309 CR 48, ROSHARON, TX, 77583.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii). The employer does not ensure that each employee exposed to fall hazards is trained by a competent person. This violation occurred on or about August 1, 2012, on the roof of a newly built elementary school where employees cleaning the area on a low-slope roof were not trained on fall hazards.
