29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):    a) There was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site, materia;l and equipment such as residential wall/window openings, stud wall top plate truss erection and perimeter exterior stud wall erection fall protection devuices or systems were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    a) On or about August 2, 2012 and prior to that time located along various areas of the residential structure employee(s) were observed framing adjacent to unprotected wall/window openings, performed perimeter exterior stud wall top plate truss erection and perimeter exterior studwall erection without conventional fall protection or alternative fall protection systems or methods and were exposed to fall potentials in excess of 18'.
