29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    The employer does not protect employees from being ejected when working from an aerial lift. This violation was observed at the construction site on July 31, 2012 where an employee was exposed to a fall hazard of 23 ft. while performing work from an aerial lift without wearing a restraint system.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    The employer does not ensure that all ladders used by employees are extended 3 feet above the upper landing surface. This violation was observed at the construction site on July 31, 2012 where employees were exposed a fall hazard of 23 ft. while using a ladder that was not extended 3 feet above the upper landing.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    The employer does not protect employees engaged in a steel erection activity from falling when working 15 feet or more above lower levels. This violation was observed at the construction site on July 31, 2012 where employees were exposed to a fall hazard of 23 ft. while performing construction activities without fall protection.        Ameri-Tex Builders, Inc was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.760(a)(1), which was contained in OSHA inspection number 311887640, Citation Number 1, Item Number 6 and was affirmed as a final order on 8/28/2008, with respect to a workplace located at John Stockbauer Dr. & NE Zac Lentz Pkwy., Victoria, Texas 77904.
