29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) Worksite, west side of building- Employees were not wearing protective helmets and were exposed to being struck by overhead materials such as, but not limited to hand tools and buckets while working directly below the scaffold; on or about 08/04/12.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  a) Worksite, west and north sides of building- Employees were working on a fabricated frame scaffold at the 12' level which had only three planks installed. Three planks were missing, leaving an opening approximately 27" wide; on or about 08/04/12.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
