29 CFR 1918.94(a)(1):  When internal combustion engines exhaust into a hold, intermediate deck, or any other compartment, the employer did not ensure that the atmosphere is tested as frequently as needed to prevent carbon monoxide (CO) concentrations from exceeding allowable limits.     a. On or about 05/25/12, at 3rd deck, El Morro vessel, Sea Star pier, San Juan, PR. Employees were exposed to carbon monoxide (CO) gases form the gasoline and diesel engines of vehicles and container trucks moving cargo to vessel inner areas. The employer did not perform carbon monoxide (CO) air sampling needed to prevent concentrations for exceeding allowable limits.     NOTE:  Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     a. On or about 05/25/12, at the mantenance shop, at Sea Star facilities, San juan, PR.  The employer did not develop a written hazard communication program to ensure having material safety data sheets for pre-buff cleaner, oils, fluids and compressed gases such as oxygene when employees replaced empty tanks with full ones during maritime handliing maintenance operations.     NOTE: Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).

The employer did not have a material safety data sheet for each hazardous chemical such as pre-buff cleaner, oils, fluiids, and compressed oxygene gas used and/or handled by employees when replacing empty tanks and performing heave equipment maintenance operations.      NOTE: Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).
