29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On and before July 24, 2012 metal ladder(s) used during roofing activities did not extend at least 3 feet above the upper landing surface. Employees were performing tear-off and replacement of weatherproofing of a commercial building.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. As of July 24, 2012 the employer did not ensure that a portable ladder used by employees completing roofing activities were inspected prior to ladder being placed into service. Equipment includes but is not limited to, the Werner 32 feet Aluminum ladder, which had multiple holes worn in the rungs.

CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. On or about July 24, 2012 employees working on a low slop roof, were not protected from a fall of approximately 30 feet, by using an adequate fall protective system/devices. Employees were completing tear-off and replacement of weatherproofing on a commercial building. ARKRA, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR1926.501 (b) (10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313997322, CITATION NUMBER 1, ITEM NUMBER 02, AND WAS AFFRIMED AS A FINAL ORDER ON 01/11/2010, WITH RESPECT TO THE WORK PLACE AT 4488 PURITUS & W. 160TH, CLEVELAND, OH 44135.
