29 CFR 1910.266(d)(7)(i):     Hand signals or audible contact, such as, but not limited to, whistles, horns, or radios, were not utilized whenever noise, distance, restricted visibility, or other factors prevented clear understanding of normal voice communications between employees:    a. Bender Run Tract/Felling Area: The cutter was not always in visual or audible contact with the dozer and skidder operators during logging operations.  An employee was struck by a 24' long 5 1/2" diameter limb and contact with another employee was not made until several minutes afterwards when the dozer operator traveled by the area, as determined on or about July 30, 2012.    ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM.

29 CFR 1910.266(h)(2)(ii):     Before each tree is felled, conditions such as, but not limited to, snow and ice accumulation, the wind, the lean of tree, dead limbs, and the location of other trees, was not evaluated by the feller and precautions taken so a hazard is not created for an employee.    a. Bender Run Road/Felling Area: Before felling an 82' tall, 23" diameter poplar tree, conditions such as grapevines being heavily embedded in the trees, were not adequately evaluated. As the poplar tree fell, grapevines in the top of the poplar tree, and connected to a sassafras tree approximately 18 1/2' away, caused a sassafras limb to break.  The broken sassafras limb, 24' long and 2 1/2" in diameter fell and struck the cutter, as determined on June 30, 2012.      ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED FOR THIS ITEM.
