29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:    (a) At 3213 Nebraska Drive in Bismarck, ND, for employees exposed to a potential fall hazard of approximately 9 feet created by the unguarded floor openings leading from the main floor of the structure into the basement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it was infeasible or created a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) At 3213 Nebraska Drive in Bismarck, ND, for employees exposed to a potential fall hazard of approximately 10 feet created by employees standing on, or walking, the wall caps during roof truss installation.
