OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while working in a trench:    (a) LOCATION: Akimel Smoke Shop Property, 4321 East Riggs Road, Chandler, AZ 85248:  On or about 2 August 2012, the employer failed to ensure that manufacturer instructions and standard operating procedures were followed when attaching a bucket shovel to a JRB Smart-Loc quick coupler on the boom arm of a Komatsu PC200LC track hoe excavator. The employer did not remove lifting devices previously attached to the quick coupler, which could interfere with the locking mechanism. As a result, the bucket shovel detached during use and rolled into the excavation, fatally injuring an employee.     (b) LOCATION: Akimel Smoke Shop Property, 4321 East Riggs Road, Chandler, AZ 85248: On or about 2 August 2012, the employer failed to ensure that manufacturer instructions and standard operating procedures were followed when attaching a bucket shovel to a JRB Smart-Loc quick coupler on the boom arm of a Komatsu PC200LC track hoe excavator. The operator failed to perform the required "ground test" to determine if the shovel was securely attached prior to use.  As a result, the bucket shovel detached during use and rolled into the excavation, fatally injuring an employee.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    (a) LOCATION: Akimel Smoke Shop Property, 4321 East Riggs Rd., Chandler, AZ 85248: On or about 2 August 2012, the employer attached an approximate 1500 lb. bucket shovel to the quick coupler device on the boom arm of a Komatsu PC200LC track hoe excavator. The employer failed to visually inspect the quick coupler device prior to or after attachment, and prior to use.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    (a) LOCATION: Akimel Smoke Shop property, 4321 East Riggs Road, Chandler, AZ 85248:  On or about 2 August 2012, the employer failed to instruct employees and the foreman/operator of the Komatsu PC200LC track hoe excavator to recognize and avoid the unsafe condition of operating the excavator's bucket shovel in close proximity to employees. The operator swung the boom arm and bucket shovel to the end of an open excavation, exposing employees to the hazard of becoming struck by equipment falling or rolling into the excavation.
