29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Jobsite, Alcote Street, East McKeesport, PA: On or about 08/01/12, an inspection of the excavation was not made by a competent person for evidence of a situation that could result in a possible cave-in. Two persons were working in an excavation approximately 6' 3" in depth without any protective systems; an inspection by a competent person would have recognized the need for protective systems to be used.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c): (a) Jobsite, Alcote Street, East McKeesport, PA: On or about 08/01/12 two employees were working in an excavation approximately 6'3" in depth with near vertical side walls and no protective system was in place to protect the employees from the possibility of a cave-in.
