29 CFR 1926.20(b)(2): 29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 18 Opal Drive, Robbinsville, NJ: The employer did not perform frequent and regular inspections of the jobsite and did not designate a competent person to preform hazard recognition on the job site as the work progressed. The employees were exposed to fall hazards greater then 6 feet from the ground level, observed on or about 7/27/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) 18 Opal Drive, Robbinsville, NJ: Employees were exposed to fall hazard when preforming carpentry work including but not limited to setting roof joist at a height greater than 14 feet from the ground level and greater than 25 feet to the ridge, observed on or about 7/31/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
