29 CFR 1910.95(c)(1):   The employer did not administer a continuing, effective hearing conservation program whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    Employees who were engaged in pallet construction activities were not provided audiograms and noise protection training where exposures exceeded 85 dBA.    (a)  An employee was exposed to noise at an 8 hour time weighted average of 88.0 dBA, approximately 1.035 times the action level of 85 dBA; this level is established to prevent occupational hearing loss.  The sample was collected on August 22, 2012 during a 463 minute sampling period; exposure calculations include a zero increment for the 17 minutes not sampled.    (b)  An employee was exposed to noise at an 8 hour time weighted average of 90.1 dBA, approximately 1.060 times the action level of 85 dBA; this level is established to prevent occupational hearing loss.  The sample was collected on August 22, 2012 during a 464 minute sampling period; exposure calculations include a zero increment for the 16 minutes not sampled.
