29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.      Mile 13.86, Culvert #122, Denali National Park Road; on or about 31 July 2012 and times prior thereto, employees were not provided protection from a spoil pile falling or rolling back into the trench. The employer did not ensure that the spoil pile was at least two feet from the edge of the excavation. This condition exposed employees to cave-ins and caught under hazards.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.        Mile 13.86, Culvert #122, Denali National Park Road; on or about 31 July 2012 and times prior thereto, the employer did not have a competent person available to inspect for evidence of cave-ins or indications of failure of the protective systems. The competent person did not inspect the excavation/trench when modifications were made to the excavation protection system in place. This condition exposed employees to cave-ins and caught under hazards.

29 CFR 1926.652(a)(1):       Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one half horizontal to one vertical (34 degrees measured from the horizontal).    Mile 13.86, Culvert #122, Denali National Park Road; On or about 31 July 2012 and times prior thereto, employees were not provided protection from cave-ins.  The trench was not properly sloped and/or benched for the soil conditions. This condition exposed employees to cave-ins and caught under hazards.
