29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 8/6/12 an employee standing on the 4th floor balcony on the north side of the building was exposed to a fall of approximately 30 ft. to the unpaved ground level below while transferring brick to a different location and not using a personal fall arrest system. b) On or about 8/7/12 employees standing on the 3rd floor balcony on the south side of the building were exposed to a fall of approximately 24 ft. to either the dumpster or unpaved ground level below when transferring brick to a different location and not using a personal fall arrest system. c) On or about 8/7/12 employees were exposed to a fall of approximately 24 ft. to concrete at ground level below when incomplete or no guardrail system in the walk areas inside building were in place on the 3rd and 4th floor levels. Employees were carrying brick by hand from the balcony area to different locations of the building; and walking to different levels of the building passing by the exposed walkways.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) On or about 8/6/12 an employee standing on the 4th floor balcony on the north side of the building was exposed to a fall of approximately 30 ft. to the unpaved ground level below while transferring brick to a different location and not using a personal fall arrest system. b) On or about 8/7/12 employees standing on the 3rd floor balcony on the south side of the building were exposed to a fall of approximately 24 ft. to either the dumpster or unpaved ground level below when transferring brick to a different location and not using a personal fall arrest system. c) On or about 8/7/12 employees were exposed to a fall of approximately 24 ft. to concrete at ground level below when incomplete or no guardrail system in the walk areas inside building were in place on the 3rd and 4th floor levels.
