29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. On or about August 07, 2012 at the construction site located at 231 San Saba Court, Blanco, TX, where two employees had body belts on and did not attach the lanyards to the baskets or booms of the two Genie S-60 aerial lifts while another employee in one of the baskets was not wearing a body belt while in the basket. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in an aerial lift will wear a body belt and attaches the lanyard to the basket or boom.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about August 07, 2012 at the construction site located at 231 San Saba Court, Blanco, TX, employees were installing the gutter system to the perimeter edge of the building and 3 employees working on the Southeast side were leaning over the edge being exposed to a 7 foot fall. Several other employees were walking, standing and/or leaning over the edge of the South side wall of the building, exposing employees to the hazard of a 19 foot fall. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a walking/working surface with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level is protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: On or about August 07, 2012 at the construction site located at 231 San Saba Court, Blanco, TX, where an employee was using/working from a 6 foot "A" frame step ladder which he leaned up against the building instead of placing the step ladder in an open position with the metal spreader locking the front and back sections open, exposing employee to the hazard of a 4 foot fall. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladder(s) are used only for the purpose for which they were designed.
