This trench did not have a ladder or other safe means of egress located in the trench at all times, on or about July 17, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

While stone got dumped into the trench, this employee remained in the trench working beneath the dumped load, on or about July 17, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) Trench along Valley Road at Intersection with Cocoa Avenue - The competent person did not inspect the trench prior to an employee starting to work in the trench to ensure that the trench had adequate cave-in protection. An employee worked in the trench, 10.5 feet deep, dug in Type B soil at best, with a trench box placed in the bottom of the trench and with 5 feet 4 inches of trench walls unprotected from cave-in above the top of the trench box, on or about July 17, 2012. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

This trench, dug in Type B soil at best, had a trench box placed in the bottom of the trench but had 5 feet 4 inches of trench walls unprotected from cave-in above the top of the trench box, on or about July 17, 2012. N. ABBONIZIO CONTRACTORS, INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARD OR ITS EQUIVALENT STANDARD 1926.652(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314161712, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 28, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT ROUTE 61 AND 443, SCHUYLKILL HAVEN, PA 17972. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
