29 CFR 1926.452(j)(3): When guardrails were used for fall protection, a workbench may be used as the top rail only if it meets all the requirements in paragraphs (g)(4)(ii), (vii), (viii), and (xiii) of 1926.451: A). on or about 08/8/12, at the site of 190 Beach 68th Street. Arverne, NY Employees working on a pump jack scaffold were exposed to the hazard of falling approximately 15 ft. to the ground. The mid rails of the scaffolds were missed. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On or about 08/08/12, at the site of 190 Beach 68th Ave. Arverne, NY Employees installing new roof on a pitch roof with a slope of 8 in 12 ratios were exposed to the hazard of falling approximately 20 ft to the ground below. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19. SERIOUS VIOLATION: Evian Aluminum Siding Co. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection No. 311287403, Citation #1, Item #2, issued on 12/23/08 and the Final Order date on 08/13/09.
